Has a loved one been neglected or abused while staying at a nursing home?

Nursing homes are meant to be safe and caring places for the elderly and otherwise vulnerable persons.  When a family member or other loved one moves into a nursing home in Florida, we want to feel that he/she is safe and will be well cared for.  Many nursing homes in Pensacola and the surrounding area provide their residents with excellent and attentive care.  But this is not always the case.

At times, abuse and neglect can result in injuries such as:

  • Physical injury from falls
  • Malnutrition or dehydration
  • Bed sores
  • Gangrene
  • Aspiration pneumonia
  • Over-sedation
  • Poor medical care
  • Wrong medication

Protect Your Rights

By way of our Florida laws, you may not be entitled to sue for medical malpractice. In these cases, the situation must be carefully researched and analyzed, in order to find an area of the law that will protect a person who is described by our statutes as a vulnerable adult. Chapter 415.1111 Florida Statues, a new body of law arising from legislation amended in calendar year 2000, recognizes as a separate cause of action, other than nursing home neglect, the abuse, neglect or exploitation of a vulnerable adult.

Cases of nursing home neglect and/or abuse of vulnerable adults are particularly difficult ones.  The emotions in such cases are wrenching.  The victims in these cases are usually very defenseless, and normally unable to care for himself/ herself.  Many times the difficulty in proving nursing home neglect and/or abuse of a vulnerable adult is made worse by the problems in trying to discover what actually happened.

With the ever-increasing elderly population there has been a rise in nursing home neglect and/or abuse of vulnerable adults. Just as damaging but more subtle forms of neglect include lack of supervision, abandonment, sexual assault, cohesion, physical and/or mental abuse.  All of these can lead to injury or death of a patient.

Staples Ellis + Associates  understands the need for careful review of medical records in order to establish and prove the allegations necessary in such cases.  We have significant medical malpractice and negligence experience, as well as experience in defending the rights of vulnerable adults.
